Registration of title to real estate

 Since January 2016, a number of laws and regulations have been adopted, according to which the procedure for concluding contracts and registering property rights has changed.

Now, when buying real estate from a developer, you can register your ownership (enter information about the new buyer in the electronic register of the State Register of Property Rights) both at the registration service and at any private or public notary.

If you conclude a transaction with a notary, the ownership of the new buyer of the real estate will not be registered at the same time when notarialnoe udostoverenie-dogovorov/">notarialnoe zavereniyu / udstovereniyu dogovorov, and in the period for which the corresponding administrative fee has been paid.

Today, this rule applies both to the registration of ownership of primary housing and to the purchase of secondary housing.

Registration of property rights:

  • within 2 hours (rate 5%) – the cost of the administrative fee is UAH 6,890.00 kopecks
  • starting from the third hour within 24 hours (rate 2%) - the cost of the administrative fee is UAH 2,756.00 kopecks.
  • after 24 hours but no more than 2 working days (rate 1%) – the cost of the administrative fee is UAH 1,378.00 kopecks
  • starting with the third working day but no more than 5 working days (rate 0.1%) – the cost of the administrative fee is UAH 140.00 kopecks

It is clear from the above that registration of property rights is NOT carried out on holidays and weekends. The point of calculation of terms and, accordingly, the cost is from the moment of registration of the application in the electronic register.

Let's consider everything in more detail using simple examples.

Today you bought an apartment. The legal document for your apartment will be the apartment purchase and sale agreement, made on special forms of notarial documents with the signature and seal of a notary.

You have expressed a desire to register your property right within 3-5 days.

In order to start registration, you must provide the original receipt for the payment of the administrative fee in the amount of UAH 140.

Next, the notary registers your application in the electronic register. A scanned copy of the receipt is also sent to the server of the electronic register.

To confirm the registration of your application, you sign the document acceptance card, which states that in order to register the property rights, you submit the original documents for the apartment to the notary (purchase and sale agreement, gift, exchange, etc.).

Starting from the third day, you can contact the notary with whom you concluded the transaction and from whom you received the document acceptance card and, on the basis of this document, receive the originals of all documents specified in the acceptance card, as well as an Information Certificate from the State Register of Property Rights on the registration of your property rights.

Since the state policy is aimed at getting rid of paper information carriers and switching to electronic ones, do not be alarmed that the Information Certificate will be issued to you by a notary on a white sheet of paper without a signature and without a notary seal. In any case, this document is authentic.

In the future, when technically possible, the law stipulates that the notary will inform you of the unique number under which your property rights are registered, and you, in turn, can go to the website, enter this number, and print out all the information about the registration of your property rights on paper without even leaving your home.

Since the right of ownership of real estate arises from the moment of state registration of the right to it, from the moment of receiving the Information Certificate from the notary or a unique number, you are the final legal owner of the real estate you have acquired.
