    Checking the legal, i.e. legal cleanliness of real estate differs significantly for primary real estate и для secondary property. This affects which documents and legal facts need to be checked.

    Our company has a developed list of documents and information that is necessary to conduct a quality inspection. The client can provide documents and information to the lawyer both at the company's office and by sending documents to our company's e-mail or messengers. If the developer or the seller's party can provide a package of documents only in the office (notary, sales department, real estate agency, etc.) it is possible to visit the lawyer to familiarize with the documents and obtain all necessary information.

    After receiving the documents and information, as well as after payment for the service, a full verification is carried out, followed by the provision of a written report to the customer's e-mail. After the verification, the customer and the lawyer discuss each point of the report in the telephone mode, where it is indicated what documents are provided by the seller's or developer's side, what databases they are checked against, whether the information provided in the documents and databases carries risks and negative consequences for the acquisition.

        After the complex has been completed, measurements have been taken by the Bureau of Technical Inventory, and the payment for square meters has been adjusted between the developer and the investor, the next stage comes - acceptance of the apartment. Acceptance of the apartment is accompanied by the signing of the Acceptance Act.

        This procedure should not be treated as a formal signing of a document that means nothing. That is not the case at all:

        1. After signing the Apartment Acceptance Certificate, the risk of accidental destruction or damage to the apartment passes to the investor. What does this mean: if a flood, fire or other incident occurs before signing the Acceptance Certificate, the developer must restore the condition of the apartment at his own expense; after signing the Acceptance Certificate, the responsibility for restoration and repair falls on the investor.
        2. After signing the Apartment Acceptance Certificate, the investor is responsible for financing the elimination of all construction defects identified after signing the certificate.

        What does this mean: There are visible defects in the apartment. For example, when decorating the facade - a crack in the window or half a brick protruding where it should not be. These are visible defects that any investor can see without being a specialist. But there are defects that are not visually striking or are disguised by the developer's builders.

        Qualified specialists will help to see all the defects and violations of state building codes. They go to the site at the time of acceptance and record all violations in the construction site. Such violations and defects may pose a risk to the reliability and safety of the use of the property.

        Based on the results of their work, they draw up a written REPORT on the technical inspection of the property regarding the determination of the technical condition of the property (stitched, numbered, signed and sealed by a certified specialist).

        Based on this report, a Defective Act is drawn up indicating the violations and defects that the developer's representatives are obliged to eliminate within 1 (one) month.
