I don’t own a house or land in Diya

“I just registered with Diya, I have all the information, but for the search query “real estate” and “land plot” it says “no information”. How should I understand this? I heard that if a house and land are not registered anywhere (except with the BTI), then they supposedly cannot be sold, etc. Should I do this through Diya?”

The State Register of Property Rights to Real Estate has been in operation since January 1, 2013. This is commonly known as the “notary register”. Notaries and registrars of the Center for the Provision of Administrative Services are connected to it. This register is also publicly available in the Electronic Services Cabinet and in Diya.

Documents issued before January 1, 2013 are old-style documents. Previously, when it was necessary to do something with real estate: sell, exchange, donate, inherit, people went to the Bureau of Technical Inventory (BTI), submitted documents for two weeks and picked up the state registration.

The BTI database is not digitized. There is no interaction between the BTI database and the new “notary register”. Therefore, the information is not displayed in “Diia”.

Should you worry that your documents have expired and you are not the owner of the house and land? – NO

Should you necessarily enter information into the new “notary register”? – NO

Can you sell such property? – YES

BUT!!!

If you want to sell real estate now, you need to take the following steps:

Contact a notary or a real estate lawyer to check your documents. Get advice, a list of documents for the transaction, time to collect or prepare them. This should be done before you put your property up for sale, so as not to lose potential buyers.

What are the main nuances that may occur:

1)     You have not been assigned a cadastral number or you need to update the information about the land in the land cadastre database. Without this, the notary will not process the transaction!

2)     From 01.08.2021, all technical passports for apartments, houses, and commercial real estate must be entered into the Electronic Register. That is, you need to either make a new technical passport or enter the existing one into the database. Without this, the notary will not process the transaction!

3)     Get a certificate from the BTI confirming ownership. Without this, the notary will not formalize the transaction!

In addition to all of the above, there may be questions:

  2. Extracts
  3. Establishing the boundaries of a land plot, etc.
