List of documents – preliminary agreement on sale and purchase of an apartment

For conclusion of a preliminary contract for the purchase and sale of an apartment, the following documents are required:

– passport, tax code of the owner of the apartment (seller) and passport, tax code of the buyer (if a power of attorney is acting on behalf of one of the parties + the original power of attorney, the authenticity of the signature on which must be notarized, the passport and tax code of such a representative)* – only original documents

– if the apartment was purchased during marriage and is jointly owned by the spouses of the seller or the apartment the buyer acquires the marriage – the consent of the second spouse to conclude a preliminary agreement, the authenticity of the signature on which must be notarized (or the personal presence of the second spouse at the preliminary agreement with the original passport, tax code, marriage certificate) – only original documents

– if one of the parties is a widow/widower – death certificate of the second spouse and marriage certificate – only original documents

– if one of the parties is divorced – certificate of dissolution of marriage, court decision – only original documents

– the right establishing documents for the apartment (certificate of property ownership, certificate of inheritance, court decision, sales contract, gift contract, exchange contract, duplicate of sales contract, etc.) – only original documents

– technical passport for the apartment – only the original document

*if due to religion a person does not have a tax code, it is mandatory to have a stamp in his passport stating this fact

1% – state duty (calculated from the amount transferred at the time of conclusion of the preliminary contract)

5,000 UAH – notary services, mandatory payments to the Ministry of Justice of Ukraine
